What is the Minnesota Mechanical Contractor Bond?

The Minnesota Mechanical Contractor Bond is a surety bond required by the Minnesota Department of Labor and Industry (MDLI) as a registration requirement for all individuals who wish to operate in the state as mechanical contractors.

Similar to other surety bonds, this bond is a contract between three parties: the principal (the contractor), the obligee (the MDLI), and the surety company. All authorized work by the principal must comply with the state's laws, regulations, and requirements for contractors.

If the principal violates these laws and regulations, the injured party may file a claim against the principal’s bond. After an investigation into the validity of the claim, the surety will compensate the injured party up to the full bond amount (if the claim is valid). Construction defects, physical harm, fraud, or non-compliance with contracts are all possible causes of claims.

In contrast to a typical insurance policy, a surety bond requires the principal to reimburse the surety company as a result of each claim. The bond does not protect the contractor from financial responsibility.

Who has to get this bond?

The state of Minnesota requires mechanical contractors working within its boundaries to obtain the MN Mechanical Contractor Bond.

Minnesota Statutes define a mechanical contractor as an independent business carrying out gas work, heating, ventilation, cooling, air conditioning, fuel burning, or refrigeration.

Mechanical contractors are not required to acquire a Minnesota state contractor license, but they are obligated to complete a business registration form along with their bond application. That said, individual cities within Minnesota have the authority to impose specific regulations regarding licensure or competency cards for individuals engaged in mechanical work.

The MDLI does not issue these licenses or competency cards; therefore, if you have inquiries, we recommend you research and review the requirements of the city/local municipality where you will be operating.
